Terms, refunds, privacy and risk.

Everything binding, in one place, written to be read rather than skimmed past. If anything here is unclear, ask before you buy — not after.

Section 01

Terms of Service

These terms govern your purchase and use of Athena, a Windows application that places automated futures trades on your behalf through your own broker connection. By purchasing, installing or running Athena you agree to them. In these terms, "we" and "us" mean the operators of Athena, reachable on Discord at rakahen or twzst_; "you" means the person the licence is issued to.

1.1 What you are buying

You are buying a licence to use one copy of Athena on one machine. You are not buying the software itself, its source code, or any ownership interest in it. We retain all intellectual property rights in Athena, including the compiled executable, its trading logic, and its licensing system.

1.2 Scope of the licence

If you replace your computer or rebuild it, your Request Code changes. Contact us and we will reissue a key against the new machine at no charge — that is a hardware change, not a second licence.

1.3 Activation and licence term

Athena will not trade until it has been activated. Activation keys carry an expiry date and are renewed through the same Request Code exchange. A key that has expired stops the software from trading; it does not delete anything or affect positions already at your broker.

You are solely responsible for every order placed through your account, whether you pressed the button or Athena did. That includes ensuring your use of automated software complies with the rules of your broker and your prop firm, keeping your machine and connection running during sessions, monitoring your account, and keeping your activation key confidential.

1.7 No warranty

Athena is provided as is. Software contains defects. Markets gap, feeds drop, APIs change, and machines go to sleep at inconvenient moments. We do not warrant that Athena will run uninterrupted, error-free, or that it will behave as expected in every market condition. We make no representation that using it will be profitable.

1.8 Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to Athena is limited to the amount you paid for your licence. We are not liable for trading losses, missed profits, lost opportunities, account breaches, failed evaluations, data loss, or any indirect or consequential damages, whether caused by a defect in the software, a failure of your systems, a failure of your broker's systems, or market conditions.

Nothing in these terms excludes liability that cannot lawfully be excluded.

1.9 Termination

We may revoke a licence without refund if you breach these terms — in particular by redistributing the software, attempting to defeat the licensing system, or reselling access. You may stop using Athena at any time; see the refund policy below for what that means financially.

1.10 Changes

We may update these terms. Material changes will be reflected in the "last updated" date at the top of this page. Continuing to use Athena after a change means you accept the revised terms. Changes are not retroactive to a dispute already raised.

1.11 Governing law

These terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Any dispute will be brought in the courts located in that state.

Section 02

Refund Policy

Athena is a machine-bound licence for downloadable software. Once a working key has been issued against your hardware, the licence cannot meaningfully be returned. That shapes the whole policy, so here is exactly where the line sits.

2.1 You get a full refund if

In those cases contact us on Discord, we revoke the key, and you get the full purchase price back through the method you paid with.

2.2 You do not get a refund for

This is why we ask you to run it on a practice account first. A practice run costs you nothing and shows you exactly how Athena behaves across a full session — including on a losing one. Do that before you point it at anything funded, and before the refund window stops being relevant.

2.3 How to request one

Message rakahen or twzst_ on Discord with your Request Code and a description of the problem. We will try to fix it first, because a working copy is better for both of us. If it cannot be fixed, the refund is processed within 14 days.

2.4 Chargebacks

Please talk to us before disputing a payment. A chargeback filed without contacting us first will result in the licence being revoked immediately, and we will contest it with the delivery and activation record.

Section 03

Privacy Policy

Athena runs entirely on your machine. There is no Athena account, no Athena server holding your data, and no analytics pipeline. The short version: we know your Discord handle, your Request Code, and that you paid. That is close to the whole list.

3.1 What we collect

Discord handle
Because that is how you contacted us and how we deliver your key and support.
Request Code
A value derived from your machine's hardware, used to bind your licence to it. It identifies a computer, not a person, and cannot be reversed into your files, identity or location.
Purchase record
Date, amount, and which key was issued to which code — kept so we can honour renewals, support and refunds.
Anything you send us
Messages, screenshots or logs you choose to share while getting support.

3.2 What we never collect

3.3 Payment information

Payment is handled by the payment provider you send funds through. Card numbers and banking details go to that provider, not to us; we see only what the provider shows us, typically that a payment cleared and who sent it. That provider's own privacy policy governs what it does with your information.

3.4 Third parties

We use Discord for communication and a payment provider for money. Both are independent companies with their own privacy practices. We do not sell, rent, or share your information with anyone for marketing, and there is no advertising or tracking on this website.

3.5 This website

This site is a static page served from a host. It sets no tracking cookies, runs no advertising pixels, and does not profile visitors. The host may keep standard server logs, such as IP addresses and requested pages, for security and operational purposes.

3.6 Retention and your rights

We keep purchase and licence records for as long as your licence is active and for a reasonable period afterwards, for tax and dispute purposes. You can ask us what we hold on you, ask for it to be corrected, or ask for it to be deleted — message either handle above. Deleting your licence record means we can no longer issue renewals for that key.

Section 04

Risk Disclosure

Trading futures is risky and most people who try it lose money. Automating it does not change that. Athena removes hesitation, revenge trades and moved stops — it does not remove market risk, and it cannot make a losing strategy profitable.

Only trade with money you can afford to lose entirely.

4.1 Futures risk

Futures contracts are leveraged instruments. Small moves in the underlying index produce large moves in your account. Losses can accumulate quickly and, on a directly funded live account, can exceed your initial deposit. On a prop firm evaluation or funded account your financial exposure is generally limited to the fees you have paid that firm, but the account itself can be closed by a single breach of its drawdown rules.

Any results shown on this site or in our communications — including practice-account results, backtests and simulated performance — are historical or hypothetical and carry the well-known limitations of such figures. Past performance is not indicative of future results.

Hypothetical or simulated performance results have inherent limitations. Unlike an actual performance record, simulated results do not represent actual trading and may not reflect the impact of factors such as liquidity, slippage, latency or execution delays. Because the trades were not actually executed, results may under- or over-compensate for these factors. No representation is being made that any account will or is likely to achieve profits or losses similar to those shown.

4.4 This is not advice

Athena is a tool you operate. Nothing on this site, in the software, or in any message from us is investment advice, a recommendation, a solicitation to trade, or an offer to manage money. We are not registered investment advisers, commodity trading advisors, or brokers, and nothing we provide should be treated as coming from one. If you want advice, get it from a licensed professional who knows your circumstances.

4.5 Independence

Athena is an independent third-party product. It is not affiliated with, endorsed by, sponsored by, or connected to TopStep, TopStepX, ProjectX, CME Group, Nasdaq, or any exchange or prop firm. All trademarks belong to their respective owners. Your relationship with your prop firm is governed entirely by that firm's own agreement, including whether and how it permits automated trading — check that before you run anything.

4.6 Your decision

By buying and running Athena you confirm that you understand the risks described here, that you can afford to lose the capital you put at risk, and that responsibility for every trade placed in your account rests with you.
